Terms of Service

1. Who we are

These Terms of Service (the “Terms”) govern your use of the Kultura mobile web application, the website at pay.kulturapay.com and related services (together, “Kultura” or the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

Kultura is operated by the Kultura group of companies (“we”, “us”). Payment processing, currency conversion and identity verification are performed together with licensed partners as described in the app.

2. Eligibility

You may use Kultura if you are at least 18 years old, are able to enter into a binding agreement, and hold a valid passport, national ID card or driver’s licence accepted by our verification partner. The Service is intended for visitors to Russia; we may restrict availability by country of residence, document type or other criteria at our discretion.

3. Your account

You register with a phone number and confirm it with a one‑time code, then add an email address and password. You are responsible for keeping your credentials secret and for all activity under your account. Tell us immediately at hello@kulturapay.com if you suspect unauthorised access.

One person may hold one account. We may suspend accounts that appear to be duplicated, shared, or used on behalf of someone else.

4. Identity verification

Before your first top‑up you must complete identity verification: choose your document, photograph it and pass a short liveness check. Verification is performed by a regulated partner. We may request additional documents at any time, and we may decline or revoke verification without giving reasons where the law requires us to do so.

5. Balances and top‑ups

Your Kultura balance can be held in US dollars, euros and USDT. You can top up by transferring USDT on the TRC‑20 or ERC‑20 network to the address shown in the app, or with a Visa or MasterCard card issued in your name.

• Send only USDT on the network selected in the app. Other tokens or networks cannot be recovered.
• Card top‑ups are subject to the card issuer’s approval and our fraud checks.
• A balance is not a bank deposit and does not earn interest.

6. QR payments

When you scan a merchant’s payment QR code, the app shows the merchant, the amount in rubles, the exchange rate, our fee and the total that will be deducted from the balance you selected. The rate is locked for 60 seconds. A payment is made only after you confirm it. Confirmed payments cannot be reversed by us; refunds are a matter between you and the merchant.

7. Fees and rates

Our standard fees are published on the Fees section of the website and in the app: 0.5% per QR payment, 0% for USDT top‑ups and 1.5% for card top‑ups. Conversion uses the mid‑market rate at the moment of the payment. Fees are always shown as a separate line before you confirm. We may change fees with notice in the app.

8. Withdrawals

Unused balance can be kept for future trips or withdrawn to a USDT wallet you control, subject to verification status, network fees and applicable limits shown in the app.

9. Prohibited use

You must not use Kultura for anything unlawful, to pay for goods or services prohibited by law, to launder money or finance terrorism, to evade sanctions, or on behalf of a third party. You must not attempt to interfere with the Service, reverse‑engineer it or access it by automated means.

10. Liability

The Service is provided “as is”. To the extent permitted by law we are not liable for indirect losses, for merchant goods or services, for delays caused by blockchain networks or card issuers, or for losses caused by your failure to keep credentials secure. Nothing in these Terms limits liability that cannot be limited by law.

11. Changes and termination

We may update these Terms; the current version is always at pay.kulturapay.com/terms. Continued use after a change means you accept it. You may close your account at any time after withdrawing your balance. We may suspend or close accounts that breach these Terms or where required by law.
